Late last year, I presented an introductory seminar on avoiding vesting of security interests under the PPSA. The seminar was conducted at the Leo Cussen Institute.
The basic concepts covered in the seminar were:
•The nature of a security interest
•Registration
•Common Defects in Registration
•Vesting of unperfected security interests: s267 of the PPSA
•Vesting of security interests registered out of time: s588FL of the Corporations Act 2001 (Cth)
Vesting risk is the most common issue requiring advice or litigation regarding the PPSA.
